I say, and with God's help: For someone who does not find the time for prayer, such as someone living in a country where dawn breaks before the twilight disappears, like Germany and other northern European countries, there is a period of the year when the red twilight does not disappear in those countries, but remains until it mixes with the dawn twilight at the break of dawn. Scholars of the school differ on whether the night prayer (Isha) is obligatory for him or not. The first opinion is that it is not obligatory: and he is required to perform four prayers. This was issued by Al-Baqali, and Imam Al-Halwani returned to it, and Al-Marghinani followed him, and Abu Al-Barakat Al-Nasafi, and Mulla Khusraw affirmed it, and Al-Halabi and Al-Shurunbulali favored it, and Al-Haskafi chose it. They supported this by the absence of the cause, which is time, thus it is dropped just as washing the hands in ablution is dropped for one whose hands are cut off at the elbows. The second opinion is that it is obligatory for him to pray: and he does not intend to make up for it in the correct view due to the absence of the time for performance. This was issued by Sheikh Burhan Al-Din Al-Kabir, and Ibn Al-Shuhna confirmed it, and it was chosen by Al-Kamal Ibn Al-Humam, and Al-Tamurtashi, and this opinion was supported by Al-Marjani in an independent message he called: "The Lens of Truth on the Obligation of Isha Even if the Twilight Does Not Disappear." They supported this by: First: the consensus on the obligation of the five prayers, which is general for the people of the horizons without distinction between one country and another, and this is indicated by the Prophet's saying: "Five have been prescribed by God upon the servants," in Sunan Abu Dawood 1: 115, Sunan Ibn Majah 1: 449, Al-Muwatta 1: 123, and Sunan Al-Nasa'i Al-Kubra 1: 142. Second: The Prophet (peace be upon him) mentioned the Dajjal, and we asked: How long will he stay on earth? He said: Forty days: a day like a year, a day like a month, a day like a week, and the rest of his days are like your days. We said: O Messenger of God, on that day which is like a year, do we suffice with the prayer of one day? He said: No, estimate it, in Sahih Muslim 4: 510, Sunan Al-Tirmidhi 4: 2250, Musnad Ahmad 4: 184, and Al-Mustadrak 4: 537. He made more than three hundred Asr prayers obligatory when the shadow becomes like or double its length, and you can apply this reasoning. Thus, we understand that the obligation in reality is five in general, but their distribution at those times exists, and the obligation does not drop after them. Imam Al-Laknawi said in Nafi' Al-Mufti and Al-Sail, p. 193: "The conclusion is that there are two correct opinions." However, we act according to the opinion that makes prayer obligatory; as a precaution, and we do not deny those who follow the opinion of those who do not make it obligatory.
