If the passerby aligns with the praying person, he is sinful; otherwise, he is not. This is because the sin of someone passing in front of the praying person is conditional upon alignment and the absence of a barrier between him and the praying person. If he prays on an elevated place, passing in the location of his prostration is not conceivable. See: Majma' al-Anhar 1: 121.
