What is the ruling for someone who catches the Imam while he is bowing, bends his back, then says Takbir while he is closer to bowing than to standing?

It is not valid for him to start the prayer; because it is a condition for the validity of the opening takbir to perform it while standing or slightly bending before the bending reaches the position closer to bowing, and here the condition has not been met. See: Maraqi al-Falah, p. 217.
