The Wife's Residence in Her Husband's House During a Dispute and Conflict Case
Is it permissible for the wife to live in the same house as her husband if there is a dispute and conflict case between them while waiting for the court's ruling on divorce? Is it permissible for the woman to deny herself from him in this case? Is it permissible for her not to serve him, not to speak with him, and to avoid him? If the divorce occurs in this case through the court, does she observe the waiting period in her husband's house or in her family's house?
Answer
I say, and with God's guidance: The wife remains in her home and fulfills her duties towards the children and the husband by communicating with him and performing her household responsibilities towards him; because she is still his wife. May Allah, the Exalted, reconcile their hearts and restore their relationship to its natural course. In the event of divorce, the wife observes her waiting period in the marital home; because it is her right. If it is an irrevocable divorce, she should be in a part of the house where she feels secure from him. And Allah knows best.
