The Waiting Period of a Woman in Minor Divorce
Does a woman who has been divorced in a minor divorce observe her waiting period in the marital home? Is it permissible for the husband to take her back before the waiting period ends without a new dowry and contract, and without her consent as well?
Answer
I say, and with God's success: The revocable divorce allows for the return without a dowry, contract, or consent, while the irrevocable divorce requires a dowry, contract, and consent. However, she must observe the waiting period in the marital home where she feels safe from her husband; because she is forbidden to him. And God knows best.
