Question
A woman’s husband passed away, leaving her with a son and a daughter, along with a sum of money that has been distributed according to Islamic law, in addition to several gold coins that remain with the wife. She pays the zakat on this gold every year. Is it permissible for her to sell some of this gold to pay for the house rent and her expenses, knowing that she does not work, her daughter is married, and her son works and studies?
Answer
I say, and with God's help: It must be distributed to the heirs because it is their right, and she is not allowed to act except with her share of it, unless the remaining heirs waive their rights to her, in which case it is permissible. And God knows best.
