The Ruling on the Debt of the Deceased if Forgiven by the Heirs
If there is a debt owed by a deceased person to someone, and the heirs forgive it, does it fall from him, and is it permissible to give charity with the amount on behalf of the deceased?
Answer
I say, and with God's help: If the deceased or his heirs forgive him, the debt is lifted from him. If they do not forgive him, the money must be returned to them, and it is not permissible to give it as charity. And God knows best.
