A married woman who is pregnant had her husband arrested. She gave birth to a daughter during her husband's imprisonment. After some time, she went to establish the lineage of her daughter and learned that she had been divorced for 4 years. Now her husband has been released from prison and wants to return to his home, claiming that he has reviewed her in his mind after the divorce without going to court. What is the ruling on the marriage now?
Answer
I say, and with God's help: If he pronounces her return with his tongue during her waiting period, this is valid if he confirms it now; otherwise, it is not valid, and he must contract with her again and pay her a dowry. And God knows best.
