Question
An elderly lady receives a sum of money monthly, and this money has been entrusted to her son. This son has been taking from this money as a loan, then the mother permitted this son to take his needs from the money. In the event of the mother's death, is what the son took considered inheritance, and must it be returned and distributed among the heirs, or is it a gift?

I say, and with Allah's success: If the mother owned the money as a permission, then it belongs to him, and he is not required to return it in the inheritance. If she permitted him to benefit from it as a loan, then he must return it and distribute it as inheritance. And Allah knows best.
