Question
My father had a piece of land, and he wrote the land in his father's name to take a military housing loan worth (5000) dinars. After two years, my father paid (1500) dinars of the loan, leaving (3500) dinars. Then, after that, his father passed away, and the army waived the remaining amount. Do the heirs have a right to the amount of (3500) dinars?
Answer
I say, and with Allah's success: It is assumed that his father should return the amount to his son's heirs because it is their right. They also have the right to the remaining mentioned amount, and Allah knows best.
