A husband said to his wife: If you go to your family's house, you are divorced. His intention was to prevent her from going, not to actually divorce her, due to a disagreement between him and her brother. Her father has returned from travel, and she wants to visit him. What should she do?
Answer
I say, and with God's success: If he intends by his oath to completely prevent her from going, the divorce takes effect when she goes, even after some time. If he only intends to prevent her from going right now, then if she goes after a while, the divorce does not take effect. He should consult the mufti to ensure his wording and intention, and God knows best.
