I say, and with God's help: He asks about his intention; if he intended to pronounce the declaration of separation (zihar), then it is considered zihar, and he must perform the expiation for zihar by fasting for two consecutive months before they have sexual relations. If he is unable to do so, he must feed sixty poor people before they have sexual relations. If he intended an oath, then he must perform the expiation for the oath. And God knows best.
