A father bequeathed to his son to take his brother's share in the event that his brother does not divorce his wife. Is his will executed or not?

I say, and with God's success: The will is not considered in the rights of the heirs; because their rights are determined by God Almighty. The will is only executed for those who are not heirs, and God knows best.
