Question
Does the oath of immediate action in Hanafi jurisprudence apply to certain oaths, such as when someone asks for his brother's car, and he does not give it to him, so he swears that he will not ride it again, but he rides it another day, is this considered an oath of immediate action meaning he has no expiation?
Answer
I say, and with God's success: The oath of the fast depends on the intention. If he intends not to ride it now and then rides it later, he has no expiation. But if he intends not to ride it at all, then he must expiate if he rides it later. And God knows best.
