Selling by Writing via Telex, Fax, and Email

Question
Is it permissible to sell by writing via telex, fax, and email?
Answer
I say, and with God's success: The sale by writing can be extended to sales via telex, fax, email, WhatsApp, and other social media platforms if it is in writing, unlike when the communication between them is direct by voice, as it has the ruling of an oral contract, and they are considered to be in one session. Our Sheikh Al-Othman said in the jurisprudence of sales (1: 27-28): "Telex and fax are analogous, as offering and acceptance are permissible through them, provided they are secure from forgery... As for the telephone and wireless device, contracting through them is like contracting orally, even if one does not see the other; because that is not a condition for the validity of the contract... However, the contract between two distant persons, whether through telex and fax or through telephone or wireless device, is only valid in matters where possession is not required in the contract session; as for contracts that require possession in the contract session, such as currency exchange, they cannot be completed through these devices unless each has an agent for delivery at the other party's location," and God knows best.
