Question
A person owns a truck that has monthly installments and is unable to pay the installments. He offered a friend to buy it from him in cash, then he would buy it back with a down payment and the remaining amount in installments, with an increased profit on the amount. The truck remained in his name without a transfer, and the person paid off his old installments and gave his friend a down payment, and financed the remaining amount in installments.
Answer
I say, and with God's guidance: What they did is called a sale of 'Aynah, which is well-known in the books of jurisprudence. It is a type of usury and is therefore prohibited by law; it is not permissible to buy from someone in cash and then purchase from them in installments at a higher price, as in the hadith of Aisha, may God be pleased with her, with Zaid ibn Arqam. And God knows best.
