Ruling on Overlapping Waiting Periods
A woman was divorced by her husband, and before the end of her last menstrual cycle, he passed away. Does her waiting period end with the last menstrual cycle, or does she complete the waiting period for the death?
Answer
I say, and with God's success: If her divorce is irrevocable, her waiting period ends with the end of the divorce waiting period; because she is no longer a wife. If her divorce is revocable, a new waiting period begins upon the death of her husband; because she is still his wife. And God knows best.
