Returning the expiation of an oath for the one who swore without his knowledge
A man swore an oath of divorce on his wife, and he was told to give an expiation for the oath. His wife gave the expiation to her mother to distribute it, but the mother did not find anyone who needed it more than her daughter and her children, so she gave the expiation without her knowledge. Is this permissible?
Answer
I say, and with God's guidance: The oath of divorce results in divorce, and there is no expiation for it. You should consult the mufti about this. The expiation for the oath must be given to the poor, and it is not permissible for a person to spend it on themselves under the pretext that they are poor. And God knows best.
