Returning a Woman During Her Menstrual Period
If a woman is menstruating and her husband gives her a second divorce, what should she do? Is it permissible for her husband to take her back at that moment, or does he need to have a new marriage contract and witnesses?
Answer
I say, and with God's help: If a man divorces his wife during her menstrual period, the divorce is valid, and he is allowed to take her back if he divorced her with the phrase 'You are divorced'; because it is a phrase of revocable divorce even if it is the second divorce. And God knows best.
