Question
My father entrusted a sum of money to my mother for savings as usual, and my mother took part of this money without informing him, spent part of it, and what remained was left. Then my father passed away. Is the money she took considered inheritance and must she return it, knowing that she spent part of it before his death, or is this money rightfully hers because she took it during his lifetime?
Answer
I say, and with God's help: It was not permissible for your mother to take the money without the father's permission, and she is accountable for that. However, it is not considered part of the inheritance, and she is not obligated to return it; because she spent it on their living necessities, and God knows best.
