What is your response to those who say that the Hanafi school establishes ownership for the usurper, and thus ownership is established for the Jews in Palestine according to the Hanafis?
Answer
I say, and with God's success: The ownership of what is usurped can only be in special cases; because the usurped has transformed into something else, thus it no longer retains its original nature. This is different from the occupation of lands, where the right to them remains with the Muslims until the Day of Judgment; because the right of Islam in it does not cease; therefore, jihad in this regard has become an obligation upon every Muslim and Muslimah, and God knows best.
