Marriage Contract Without Witnesses and Guardian
Is it permissible to marry without documentation or witnesses, with a proposal from the man and acceptance from the woman? Is it permissible for her to marry herself if she resorts to such a marriage out of fear that they will reject her marriage, and fear that they will take her children, and she is afraid for herself of falling into sin?
Answer
I say, and with God's success: It is forbidden for a woman to marry herself without documentation before a judge and registration in the Sharia courts; because it leads to the loss of her rights. It is not considered a legitimate marriage without witnesses, but rather an act of adultery, and excuses in this matter are not taken into account. And God knows best.
