Electronic Marriage Contract
My brother is in Austria, and his fiancée is in Iraq. Is it permissible to conduct their marriage contract with the presence of family members from both sides, and can the contract formula be performed by him via phone camera? Is this considered a valid marriage contract fulfilling its conditions?
Answer
I say, and with God's success: If the presence of the spouses or one of them for the contract is through communication means, the contract is valid, and it is considered a judicial assembly with all the rulings of a real assembly. God knows best.
