Documenting the Marriage Contract in Court
A woman asks that a person proposed to her, and they got married, but the contract was not written in court, noting that the contract was made in the presence of witnesses and guardians. What is the ruling on the contract?
Answer
I say, and may Allah grant success: It must be documented in court to avoid prohibition and sin, as these contracts outside of courts do not protect the rights of the wife and children, and it is forbidden to do so. And Allah knows best.
