Question
We had a clothing shop for rent, and after my husband's death, we rented it for 250 dinars. Is this amount considered inheritance and should it be distributed among the heirs as part of the inheritance, or should it be spent on household necessities? Note that I have one son and one married daughter, and one son and five daughters living at home.
Answer
I say, and with God's success: The property among them is divided as inheritance, with the male receiving the share of two females, and the rent is the same. It is not permissible to spend it on household necessities except after the agreement of all the heirs; because it is their right, and whoever among them refuses will be given their share of the rent. And God knows best.
