Deducting an Amount from Profit in Speculation
Khalid asks Zaid for one hundred thousand dinars, saying, 'I will sign a contract with the company for a full year, and I want to speculate with your money and give you forty thousand dinars every month.' Zaid also takes one hundred thousand dinars from Ali, telling him, 'I will give you thirty thousand dinars every month, and ten thousand dinars for myself.' Is this transaction correct, knowing that after Khalid signs the one-year contract with the foreign company, he can give the amount he promised to Zaid every month without increase or decrease?
Answer
I say, and with God's success: Speculation is a type of partnership, and the condition for its validity is that the profit be a common share, such as (50%) for example, not a specific amount. The mentioned form is permissible if it is described this way by each of them, and God knows best.
