Combining the Intention of the Sacrifice and the Aqeeqah

What is the ruling on combining the intention of the sacrifice and the Aqeeqah?
Answer
I say, and with God's guidance: It is not correct to combine the intention of the sacrifice (udhiya) and the intention of the aqeeqah in one sheep according to the Hanafi school, just as it is not correct to combine the Sunnah of Dhuhr and the obligatory Dhuhr in one prayer. It has been widely circulated on some websites that it is permissible to combine the aqeeqah and the sacrifice according to the Hanafis, and this is far from the truth; because it is not permissible to combine intentions in acts of worship, and each act of worship is specific to its intention and action. It is not said that it is permissible to perform the obligatory and the Sunnah with one intention, and similarly for fasting, whether obligatory or voluntary. Because if one intends with obligatory fasting, such as a vow, to fast a voluntary fast, his fast will be valid for the stronger intention, which is the obligatory one, and we do not say that it is valid for both. Perhaps the source of this confusion is that the aqeeqah, according to the esteemed Hanafis, is a general act of worship like other acts of worship and is not prescribed by itself, as mentioned in Badai' al-Sanai' 5: 69; because the sacrifice has abrogated its Sunnah as mentioned in some narrations. Ali (may Allah be pleased with him) said, peace be upon him: "The sacrifice has erased every slaughter that was before it" in Sunan al-Daraqutni 4: 278. Al-Tahanawi said in I'la al-Sunan 17: 121: Hasan, and from Ibrahim al-Nakha'i and Muhammad ibn al-Hanafiyyah: "The aqeeqah was in the pre-Islamic era, and when Islam came, it was rejected" in al-Athar 1: 238, and others. Therefore, some thought that the sacrifice could take its place and that it would be permissible to combine them. However, the research is foundational and related to the abrogation of the aqeeqah by the sacrifice, so the aqeeqah becomes one of the acts of worship like other sacrifices, and Allah knows best.
