The Suspended Oath
A wife swore that if her husband did not allow her to visit her brother-in-law, he would not allow her to visit her sister in a distant city. After that, the husband regretted it. What is the solution? Can the husband allow the wife to go to her sister in that city and meet her in a public place instead of her house, or would that result in the oath of divorce being fulfilled?
Answer
I say, and with God's help: The occurrence of the oath is binding, and if it is met in one way or another where the oath is not fulfilled, it is permissible without the occurrence of divorce. They should consult the mufti to confirm the form of the divorce, and God knows best.
