The Remnant of a Human if His Mouth is Pure

Question
What is the ruling on the remnant of a human if there is no impurity in his mouth?
Answer
I say, and with God's success: Its residue is pure and purifying for ritual impurity, as it removes actual impurity from clothing and the body, and it removes legal impurity, which is ritual impurity and major impurity. That is, it is permissible to perform ablution and bathing with it. However, if his mouth becomes impure, and he drinks water immediately, then his residue is impure. But if he has saliva in his mouth several times and spits it out or swallows it before drinking, then his residue is not impure. There is no difference in the ruling of the residue of a human being between the adult and the child, the Muslim and the non-Muslim, and the menstruating woman and the one in a state of major impurity. Aisha (may Allah be pleased with her) said: "I used to drink while I was menstruating, then I would hand it to the Prophet (peace be upon him) and he would place his mouth on the place in my mouth and drink," in Sahih Muslim 1: 245, Sahih Ibn Khuzaymah 1: 58, and Sahih Ibn Hibban 4: 108.
