Whoever assumes ihram and conditions his ihram on the ihram of another without knowing what the other has assumed ihram for
What is the ruling for someone who assumes ihram and conditions his ihram on the ihram of another without knowing what the other has assumed ihram for?
Answer
If a person enters the state of Ihram with what another person has entered into Ihram with, and he does not know what the other person has entered into Ihram with, then his Ihram is considered as that of an ambiguous state. He is required to proceed with one of the two rituals, and he can choose which one he wishes before he begins the actions of either. If he does not specify, the following details apply: If he performs Tawaf, even if it is just one circuit, his Ihram is for Umrah, even if he did not intend it for Umrah. If he stands at Arafah before performing Tawaf, his Ihram becomes for Hajj, even if he did not intend to stand for Hajj. If he is prevented from performing the actions or misses the standing or has sexual relations, it is designated for Umrah. See: Lubab al-Manasik, p. 119.
