Rights of a Divorced Woman Due to an Illicit Relationship
My sister was married and had a relationship with someone other than her husband over the phone, and now she is divorced. Does she have rights from her husband, such as the dowry and alimony, and does she have the right to custody of the children?
Answer
I say, and may Allah grant success: She has full rights including the dowry, both the upfront and deferred, maintenance, and the waiting period. She has the custody of the children unless she has reached a level of immorality such that she is no longer trustworthy with the children, in which case she would lose her rights to them. And Allah knows best.
